Klanduch, Peter: International criminal tribunals and the development of the law of genocide

Abstract:

 

Since the establishment of the two ad hoc international criminal tribunals of the United Nations in 1990s (the International Criminal Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda) the case law on crime of genocide has increased substantially. While valued by many authors as a unique contribution to the development of legal doctrine in this area, the approach of Yugoslavia and Rwanda Tribunal in dealing with individual genocide cases has not always been coherent. The author draws attention to some of the problematic aspects of ad hoc tribunals’ decisions.
